1. Acceptance of Terms

By accessing or using BatiCheck, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree, you must not use the platform.

These terms apply to all users of the platform, including organization administrators, project managers, inspectors, contractors, and invited collaborators.

2. Description of the Service

BatiCheck is a cloud-based Construction Quality Management and Project Monitoring Platform operated by Fluxper Solutions SARL. The platform enables organizations to manage construction projects, digital inspections, defect tracking, collaboration, reporting, and related workflows.

  • Web access for organization and project management
  • Mobile inspection workflows, including offline capture where available
  • Document and report generation features
  • Multi-tenant workspaces isolating each organization's data

3. Accounts and Organizations

To use BatiCheck, an organization account and authorized user accounts are required. You are responsible for maintaining the confidentiality of login credentials and for all activity under your accounts.

Organization administrators are responsible for managing users, roles, permissions, and the accuracy of project and inspection data entered into their workspace.

4. Acceptable Use

You agree to use BatiCheck only for lawful professional purposes related to construction quality management and project monitoring. You must not misuse the service or attempt to interfere with its security or availability.

  • Do not upload unlawful, infringing, or harmful content
  • Do not attempt unauthorized access to other tenants or systems
  • Do not reverse engineer or disrupt platform infrastructure
  • Do not use the service to send spam or abusive communications

5. Customer Data

Your organization retains ownership of the project, inspection, defect, document, and user data submitted to BatiCheck. You grant us a limited license to host, process, and display that data solely to provide and improve the service.

You are responsible for obtaining any consents required to collect and process personal data of your users and collaborators through the platform.

6. Availability and Changes

We strive to keep BatiCheck available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may evolve over time as we improve the platform.

We may update these Terms and Conditions from time to time. Continued use of the platform after changes become effective constitutes acceptance of the updated terms.

7. Limitation of Liability

To the maximum extent permitted by law, Fluxper Solutions SARL shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from use of the platform.

BatiCheck is a professional tool that supports construction quality processes; final decisions, site safety, contractual obligations, and compliance remain the responsibility of the customer and project stakeholders.

8. Governing Law

These Terms and Conditions are governed by the laws of Tunisia. Any dispute arising out of or relating to these terms or the use of BatiCheck shall be subject to the competent courts of Tunisia, unless mandatory law provides otherwise.
